Agreement to Terms
By accessing or using Prime Equipment Rentals' services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.
Equipment Rental Terms
Rental Period
The rental period begins when equipment leaves our facility and ends when it is returned and checked in. Daily rentals are based on a 24-hour period. Weekly rentals are based on a 7-day period (168 hours).
Payment Terms
- Payment is due at the time of rental unless credit terms are approved
- We accept major credit cards, checks (with approval), and cash
- A security deposit may be required and will be returned upon satisfactory return of equipment
- Late fees apply to overdue rentals at 150% of the daily rate
- A minimum rental period may apply to certain equipment
Delivery and Pickup
Delivery and pickup services are available for an additional fee. The customer is responsible for providing safe and accessible loading/unloading areas. Additional charges may apply for difficult access or extended wait times.
Customer Responsibilities
Proper Use
Customers agree to:
- Use equipment only for its intended purpose
- Follow all manufacturer's instructions and safety guidelines
- Ensure operators are qualified and properly trained
- Maintain equipment in good condition during the rental period
- Report any damage or malfunction immediately
- Not sublease or allow unauthorized use of equipment
Insurance and Liability
Customers are responsible for loss or damage to rented equipment from any cause. We strongly recommend maintaining adequate insurance coverage. Damage waiver options are available at the time of rental.
Fuel Policy
Equipment is provided with a full fuel tank and must be returned with a full tank. A refueling charge plus administrative fee will apply if equipment is not returned with a full tank.
Damage and Loss
The customer is responsible for:
- All damage to equipment during the rental period
- Replacement cost if equipment is lost or stolen
- Lost revenue if damaged equipment cannot be rented
- Excessive cleaning fees if equipment is returned excessively dirty
- Missing accessories, tools, or attachments
Cancellation Policy
Cancellations made more than 24 hours before scheduled delivery/pickup will receive a full refund. Cancellations within 24 hours are subject to a 50% cancellation fee. No-shows or same-day cancellations are charged the full daily rental rate.
Equipment Availability
While we strive to have equipment available as scheduled, we cannot guarantee availability due to unforeseen circumstances. If reserved equipment becomes unavailable, we will attempt to provide comparable substitute equipment or offer a full refund.
Safety and Compliance
Customers must comply with all applicable federal, state, and local laws, regulations, and ordinances. This includes but is not limited to:
- OSHA regulations
- Environmental regulations
- Traffic and transportation laws
- Licensing and certification requirements
- Job site safety requirements
Limitation of Liability
Prime Equipment Rentals is not liable for any indirect, incidental, special, or consequential damages, including lost profits, arising from equipment rental or use. Our total liability shall not exceed the total rental fees paid for the equipment in question.
Indemnification
Customer agrees to indemnify and hold harmless Prime Equipment Rentals from any claims, damages, losses, or expenses arising from the customer's use of rented equipment, including but not limited to property damage, personal injury, or violation of laws.
Dispute Resolution
Any disputes arising from these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the State of Texas.
Modifications to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.
